These Terms of Use ("Terms") are the end user license agreement between you and Badih Merheg ("we", "us") for the Peaches app and related services ("Peaches"). By downloading or using Peaches you agree to these Terms. If you don't agree, don't use Peaches.
Peaches is licensed, not sold. These Terms supplement Apple's Licensed Application End User License Agreement ("Standard EULA"). If they conflict, these Terms apply to the extent permitted by Apple's rules.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Peaches on Apple devices you own or control, as permitted by the App Store Usage Rules. You may not copy, modify, reverse engineer, resell or create derivative works of Peaches, or use it to build a competing service.
2. Your account and content
You're responsible for your account and for keeping your credentials secure. You own the content you create (tasks, goals, journal entries). You grant us a limited license to store and process it only to operate Peaches for you, as described in our Privacy Policy. You can delete your account at any time in Settings › Delete account.
3. Peaches Premium subscriptions
- Premium is an auto-renewable subscription available in the plans shown in the app (for example monthly or every 6 months). Prices are shown in your local currency before purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Your subscription renews automatically at the same price and duration unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription. If you don't cancel at least 24 hours before the trial ends, it converts to a paid subscription.
- Manage or cancel anytime in iOS Settings › your name › Subscriptions. Deleting the app or your account doesn't cancel the subscription.
- Refunds are handled by Apple under its policies at reportaproblem.apple.com.
4. AI features
Peaches uses artificial intelligence to suggest tasks, schedules, insights and summaries. AI output may be inaccurate or incomplete; review it before relying on it. Peaches is a productivity tool and does not provide medical, legal, financial or mental-health advice. Free accounts include a limited number of AI generations per week; Premium includes higher fair-use limits to keep the service reliable for everyone.
5. Acceptable use
Don't use Peaches to break the law, infringe others' rights, attempt to access other users' data, overload or reverse engineer our services or AI endpoints, or submit content that is illegal, harmful or abusive. We may suspend accounts that violate these Terms.
6. Availability and changes
We work to keep Peaches available but don't guarantee it will be uninterrupted or error-free. We may update, change or discontinue features. Reminders depend on your device's notification settings and may not always be delivered; don't rely on Peaches for critical or time-sensitive obligations.
7. Disclaimer and limitation of liability
To the maximum extent permitted by law, Peaches is provided "as is" without warranties of any kind, and we are not liable for indirect, incidental, special or consequential damages, or for lost data, profits or opportunities. Our total liability for any claim is limited to the amount you paid for Peaches in the 12 months before the claim. Some jurisdictions don't allow these limitations, so they may not apply to you, and nothing here limits rights you have as a consumer under mandatory law.
8. Apple
These Terms are between you and us, not Apple. Apple is not responsible for Peaches or its content, has no obligation to provide maintenance or support, and is not responsible for addressing claims relating to Peaches (including product liability, legal compliance or intellectual-property claims). In the event of any failure of Peaches to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. You confirm you are not located in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Termination
You may stop using Peaches and delete your account at any time. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination will survive.
10. Changes to these Terms
We may update these Terms and will change the date above. Continuing to use Peaches after an update means you accept the new Terms.
